We are not a lender, mortgage servicer, foreclosure consultant, or loan modification service, and we do not provide financial or legal advice to property owners.

We step in when a property cannot move through a normal sale because something is unresolved, such as an estate, missing heirs, title issue, lien, foreclosure, disputed document, or occupant situation. Blue Peak acquires residential real estate across South Carolina, frequently involving inherited, multi-heir, and estate-owned properties that require title resolution. We are seeking an experienced South Carolina attorney to serve as independent contractor counsel for Blue Peak, handling litigation and curative title matters for a consistent volume of residential real estate transactions.  Blue Peak’s goal is to accomplish clear title for resale of real estate.

This is not an employee or in-house counsel position. You'll operate your own practice, maintain full professional independence, and represent only Blue Peak. You will not represent estates, personal representatives, heirs, beneficiaries or sellers.

About the Opportunity

Work remotely, with travel within South Carolina as matters require. Blue Peak uses technology and automation in its acquisition and transaction workflows and seeks a lawyer who can improve repeatable legal processes while exercising independent professional judgment.

Blue Peak’s acquisitions often involve complex ownership issues, missing heirs, estate interests, and title defects that require thoughtful legal strategy and efficient resolution. We are looking for an attorney who enjoys problem-solving, litigation, and helping transactions move to closing.

Estate administration including opening, reopening and closing estates is handled by separate probate counsel and is outside this engagement. Blue Peak and its Counsel do not represent estates, personal representatives, heirs, beneficiaries or sellers.

Each property represents a separate legal matter, providing a varied and engaging caseload that combines litigation, title work, and transactional support.

Responsibilities

Typical matters may include:

• Developing and carrying out legal strategies to resolve title and ownership issues affecting Blue Peak’s acquisitions and resales.
• Handling curative title matters, including problems with prior conveyances, property descriptions and liens.
• Representing Blue Peak in quiet title actions, partitions, evictions and related real estate disputes.
• Representing Blue Peak in foreclosure-related proceedings, including intervention, substitution or joinder of parties, and claims to surplus sale proceeds where applicable.
• Preparing and reviewing deeds, corrective instruments and court filings needed to implement the legal strategy.
• Working alongside Blue Peak’s operations and transaction coordination team to assess legal issues, recommend next steps and carry the legal work through resolution.
• Counsel's client is Blue Peak exclusively.

Who We're Looking For

• Active member in good standing with the South Carolina Bar eligible under Rule 403
• Three or more years of relevant legal experience preferred.
• Strong litigation experience with real estate particularly:
• • Quiet title actions
  • Partition actions
  • Foreclosure-related proceedings
  • Evictions
  • Title and ownership issues involving inherited property
• Comfortable appearing in court and managing matters independently
• Strong drafting, negotiation, and problem-solving abilities
• Professional liability (malpractice) insurance
• Ability to assess complex facts, explain legal options clearly and recommend practical next steps
• Currently operating, or willing to establish, an independent law practice

Compensation & Structure

Compensation will be discussed with qualified candidates and may be structured on per-matter or transactional basis. The fee arrangement can be refined over time as we establish a successful working relationship.
